Warranty/Disclaimer:

Spanish Conquest Designs (hereinafter “Seller”) represents and warrants that Seller has good title to all Jewelry and coins sold, and that all Jewelry and coins sold are genuine and meet any legitimacy / grading standard under which they are sold. Seller makes no other warranty, express or implied, regarding the characteristics, merchantability, fitness for a particular purpose and/or investment potential of any Jewelry or coins sold, and specifically disclaims all other warranties.All sales are final.

Seller offers a ten-day (from date of receipt of order) money back guarantee for coins sold that a Customer wishes to return for any reason. Customer shall pay for any shipping or handling to return merchandise to obtain a refund of the purchase price.

Notice of Complaint

(A) Any Customer who believes that Seller has breached its warranty or who otherwise complains that Seller (or any of its agents, officers, or employees) has breached any obligation concerning or incident to the sale of Jewelry or coins shall notify Seller in writing mailed to Seller’s principal office of such complaint within ninety (90) days from Customer’s discovery of such complaint. This notice is a condition precedent to Customer’s right to take further action. Failure of Customer to furnish such notice within ninety (90) days shall bar Customer from maintaining any arbitration proceeding or other legal action against Seller.

(B) Mediation. If within ninety days following Seller’s receipt of any timely notice of complaint from a Customer, Seller and Customer are unable to resolve their dispute, then Seller and Customer shall mediate their dispute in Clark County, Nevada. Such mediation shall be conducted within a reasonable time, not to exceed one hundred eighty (180) days following Seller’s receipt of the notice. Mediation is a condition precedent to Customer’s right to take further action. Seller may recover reasonable attorney’s fees to remedy any breach by Customer of this requirement.

(C) Arbitration. Should mediation fail, then Customer’s sole exclusive remedy shall be to initiate an arbitration proceeding against Seller (or any of its agents, officers, or employees) in Clark County, Nevada, under the auspices of the American Arbitration Association. Customer shall file no lawsuit other than to enforce an arbitration award.

(D) Limitation of Damages. Customer’s damages for any claim against Seller (or any of its agents, officers, or employees) shall be limited to the purchase price of any sale in dispute. No recovery shall be made for any alleged consequential damages.

Jurisdiction and Venue. The state district courts in Clark County, Nevada, shall have exclusive jurisdiction and venue of any dispute arising in connection with any sale of currency or coins, or any other dispute, between Seller and Customer.
